1. Acceptance of Terms

Welcome to Revoluzion Automotive, part of the Revoluzion Ecosystem. By accessing or using our platform, you agree to be bound by these Terms of Service and all applicable laws and regulations of Malaysia. If you do not agree with any of these terms, you are prohibited from using or accessing this site.

2. Platform Overview

Revoluzion Automotive is a comprehensive online platform that provides multiple services including:

• Events: Discover, post, and share automotive events across Malaysia
• Marketplace: Buy and sell vehicles and automotive parts
• Service Directory: Connect with automotive service providers (workshops, detailing, modifications, etc.)
• Hub: Centralized community hub for managing listings and interactions
• Chat & Messaging: Direct communication between users
• Vehicle Showcase: Share and showcase vehicle modifications

Important: Revoluzion Automotive acts as a platform provider only. We do not organize events, verify service providers, guarantee transactions, or assume responsibility for user interactions. All transactions and engagements are between users directly.

3. User-Generated Content

3.1 Content Responsibility: Users are solely responsible for all content they post, including event listings, comments, photos, and any other information. Revoluzion Automotive acts only as a platform provider and does not verify, endorse, or guarantee the accuracy of user-generated content.

3.2 Content Ownership: You retain ownership of any content you post but grant Revoluzion Automotive a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content on our platform.

3.3 Prohibited Content: You agree not to post content that:

• Promotes illegal activities, street racing, or dangerous driving
• Contains false, misleading, or fraudulent information
• Violates intellectual property rights
• Contains hate speech, harassment, or discriminatory content
• Includes spam, malware, or malicious links
• Violates privacy rights or personal data protection laws

4. Marketplace & Transactions

4.1 Platform Role: Revoluzion Automotive provides a marketplace platform for users to list and browse vehicles, parts, and automotive-related items. We are NOT party to any transactions and do not:

• Process payments or hold funds
• Verify authenticity of listings or sellers
• Inspect, authenticate, or certify items
• Guarantee quality, condition, or legality of listed items
• Resolve disputes between buyers and sellers

4.2 User Responsibility: Buyers and sellers are solely responsible for:

• Verifying item condition, ownership, and legal status
• Conducting proper vehicle inspections (Puspakom, JPJ checks)
• Ensuring all documentation is legitimate and complete
• Negotiating terms, prices, and payment methods
• Meeting in safe, public locations for transactions
• Complying with all applicable laws (sales tax, transfer procedures)

4.3 Prohibited Items: Users may not list:

• Stolen or illegally obtained items
• Vehicles with fraudulent documentation
• Items that violate JPJ or Malaysian regulations
• Counterfeit or trademark-infringing products
• Dangerous or prohibited items

4.4 Transaction Risks: Users acknowledge risks including fraud, misrepresentation, non-payment, and disputes. We strongly recommend:

• Meeting in person to inspect items before payment
• Using secure payment methods with buyer protection
• Verifying seller identity and reputation
• Documenting all communications and agreements
• Conducting proper due diligence on high-value transactions

5. Service Providers & Directory

5.1 Listing Only: The service directory is a listing platform for automotive service providers (workshops, detailing, modifications, towing, etc.). We do not:

• Verify credentials, licenses, or certifications
• Inspect facilities or equipment
• Monitor service quality or workmanship
• Guarantee prices, availability, or service standards
• Mediate disputes between users and service providers

5.2 User Due Diligence: Users must independently verify:

• Business registration and licenses
• Insurance and liability coverage
• Reputation and customer reviews (from external sources)
• Qualifications and expertise
• Pricing and service terms

5.3 Service Provider Obligations: Providers listing services must:

• Provide accurate business information
• Maintain required licenses and permits
• Comply with consumer protection laws
• Honor quoted prices and service terms
• Maintain appropriate insurance coverage

6. Chat & Messaging Features

6.1 Communication Tool: Our chat feature enables direct communication between users. We are not responsible for:

• Content of messages exchanged between users
• Agreements or commitments made via chat
• Disputes arising from chat communications
• Delivery or reliability of messages

6.2 Acceptable Use: Users must not use chat for:

• Harassment, threats, or abusive language
• Spam or unsolicited commercial messages
• Sharing illegal content or coordinating illegal activities
• Attempting to circumvent platform fees or policies
• Phishing, scams, or fraudulent schemes

6.3 Monitoring: We may monitor chat communications for safety, security, and policy compliance purposes. We reserve the right to review reports of abuse and take appropriate action.

7. Event Information Disclaimer

7.1 No Verification: Revoluzion Automotive does not verify the accuracy, completeness, or legality of event information posted by users. Event organizers and attendees are responsible for ensuring compliance with all applicable Malaysian laws and regulations.

7.2 Event Changes: Event details, including dates, locations, prices, and availability, may change without notice. We are not responsible for any discrepancies or changes to event information.

7.3 Third-Party Events: Events listed on our platform are organized by third parties. We are not responsible for the organization, management, or outcomes of these events.

8. User Accounts & Profiles

8.1 Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

8.2 Accurate Information: You must provide accurate and complete information when creating an account and keep this information up to date.

8.3 One Account Per User: Each person may maintain only one account. Creating multiple accounts to circumvent restrictions or manipulate the platform is prohibited.

8.4 Account Termination: We reserve the right to suspend or terminate accounts that:

• Violate these Terms of Service
• Engage in fraudulent or illegal activities
• Receive multiple user complaints or reports
• Remain inactive for extended periods
• Pose security or safety risks to other users

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY MALAYSIAN LAW, REVOLUZION AUTOMOTIVE AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM:

• Marketplace Transactions: Fraud, misrepresentation, disputes, non-payment, or loss related to buying/selling on the platform
• Service Provider Issues: Poor workmanship, overcharging, damage to vehicles, or disputes with service providers
• User Content: False, misleading, or harmful content posted by users
• Events: Accidents, injuries, property damage, or issues at events
• User Interactions: Disputes, harassment, or harm from interactions between users
• Data Loss: Loss of listings, messages, or data due to technical issues
• Platform Issues: Downtime, errors, security breaches, or technical failures
• Third-Party Services: Issues with integrated services (maps, analytics, etc.)
• Financial Loss: Any monetary losses resulting from platform use

Maximum Liability: In any case, our total liability shall not exceed RM 100 or the amount you paid us in the past 12 months, whichever is less.

10. Intellectual Property

10.1 Platform IP: All content on Revoluzion Automotive, including logos, trademarks, design elements, and software, is the property of Revoluzion Ecosystem or its licensors and is protected by Malaysian and international intellectual property laws.

10.2 User Content License: By posting content, you grant us a non-exclusive, worldwide, royalty-free, perpetual license to use, display, reproduce, modify, and distribute your content on our platform and promotional materials.

10.3 Reporting Infringement: If you believe content infringes your intellectual property rights, contact us at zack@revoluzion.io with detailed information.

11. Dispute Resolution

11.1 User Disputes: Disputes between users (buyers/sellers, service providers/customers) must be resolved directly between the parties. We may provide contact information but are not obligated to mediate.

11.2 Platform Disputes: For disputes with Revoluzion Automotive, users agree to first attempt resolution through good-faith negotiation. Contact us at zack@revoluzion.io to initiate resolution.

11.3 Arbitration: If negotiation fails, disputes shall be resolved through binding arbitration in Kuala Lumpur, Malaysia, under Malaysian Arbitration Act 2005.

12. Indemnification

You agree to indemnify and hold harmless Revoluzion Automotive, its affiliates, and employees from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the platform
• Your violation of these Terms
• Your violation of any laws or regulations
• Content you post or share
• Transactions you engage in
• Services you provide or receive
• Events you organize or attend

13. Modifications to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting. Your continued use of the platform after changes are posted constitutes acceptance of the modified terms.

14. Governing Law and Jurisdiction

These Terms of Service are governed by the laws of Malaysia. Any disputes arising from these terms or your use of the platform shall be subject to the exclusive jurisdiction of the courts of Malaysia.
